Terms and Conditions
1. General Provisions
1.1. These Terms and Conditions (hereinafter – the Terms) are a legally binding document between the Buyer and MB Dramistės (hereinafter – the Seller), establishing the rights and obligations of both parties.
1.2. The Seller reserves the right to modify or update these Terms at any time. Any changes will be published on the online store’s website, and the Buyer is considered informed from the moment of publication.
2. Formation of the Purchase–Sale Agreement
2.1. The purchase–sale agreement between the Buyer and the Seller is considered concluded once the Buyer selects items, forms an order, and submits it via the online store, acknowledging that they have read and agree to these Terms.
3. Seller’s Rights
3.1. In the event of significant circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to compromise the stability, security, or functionality of the online store, or fails to comply with their obligations, the Seller has the right to restrict or terminate the Buyer’s ability to use the online store without prior notice.
4. Seller’s Obligations
4.1. The Seller undertakes to provide the Buyer with access to the services of the online store in accordance with these Terms.
4.2. The Seller undertakes to deliver purchased goods to the Buyer using the delivery method selected by the Buyer and under the conditions defined in these Terms.
4.3. If, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered, the Seller reserves the right to terminate the purchase–sale agreement after informing the Buyer. The Seller may offer a similar product. If the Buyer declines, the Seller must refund the payment within 3 business days.
4.4. If the Buyer exercises the right described in Section 5.2, the Seller must refund the Buyer within 5 business days from the day the returned goods are received.
4.5. The Seller may withhold refunds until the goods are returned to the Seller or the Buyer provides proof that the goods have been shipped back—whichever occurs first.
5. Buyer’s Rights
5.1. The Buyer has the right to purchase goods from the online store in accordance with these Terms.
5.2. The Buyer has the right to withdraw from the purchase–sale agreement within 14 calendar days from the day the goods were delivered, notifying the Seller in writing.
5.3. The Buyer may exercise the right described in 5.2 only if the goods have not been damaged, altered in essential ways, or used.
6. Buyer’s Obligations
6.1. The Buyer must pay for the purchased goods and accept them according to the procedure established in these Terms.
6.2. If, without valid reason, the Buyer refuses to accept the goods at the time of delivery, the Buyer must compensate the Seller for return shipping costs.
6.3. Upon delivery, the Buyer must inspect the condition of the package and goods together with the courier or the person delivering the shipment.
6.4. By using the online store, the Buyer confirms that they agree to and will comply with these Terms.
7. Prices of Goods
7.1. All prices in the online store are indicated in euros and include VAT. After confirming the order, delivery costs (if applicable) are added to the total amount.
8. Ordering and Payment
8.1. The Buyer selects the desired goods in the online store and adds them to the shopping cart. After forming the cart, the Buyer enters the personal details required to complete the order: name, surname, delivery address, phone number, and any additional information relevant for delivery. The Buyer confirms they have read these Terms and submits the order.
8.3. Payments may be made via Swedbank, SEB, Luminor, Citadele, Šiaulių bankas e-banking services, Visa/MasterCard cards, or bank transfer. Cash payments are available only in the physical studio located at Jakšto g. 9, Vilnius.
Payments are processed through the MakeCommerce.lt platform.
9. Delivery of Goods
9.1. When placing an order, the Buyer must provide an accurate delivery address.
9.2. The Buyer must personally accept the goods. If the Buyer cannot receive the goods but they are delivered to the specified address, the Buyer cannot make claims regarding delivery to an incorrect recipient.
9.3. Goods are delivered within the timeframe specified in the product description.
9.4. Product characteristics are listed in each product description. The Seller is not responsible for differences in color, shape, or other parameters caused by the Buyer’s monitor settings.
9.5. If the Buyer withdraws from the purchase–sale agreement, all amounts paid, including delivery costs, are refunded.
10. Return of Goods
10.1. High-quality goods may be returned within 14 days from the day of receipt. Defective goods may be repaired, replaced, or refunded in accordance with the Civil Code of Lithuania.
10.2. Returned goods must meet the following conditions:
10.2.1. Goods must be in their original, undamaged packaging (except in cases of returning defective goods).
10.2.2. Goods must not be damaged by the Buyer.
10.2.3. Goods must be unused and retain their commercial appearance—labels intact, protective films not removed, etc. (except for defective goods).
10.2.4. Goods must be returned with the same completeness as received.
10.2.5. The Seller may refuse to accept returned goods if return conditions have not been met.
10.2.6. Returns must be made using the Seller’s specified method within 14 days of receiving the goods (except for defective goods, which follow legal warranty rules).
10.3. Returns and exchanges of quality goods are made according to Article 6.22810(1) of the Lithuanian Civil Code.
10.4. Money for returned goods must be refunded to the Buyer’s bank account within 5 days from the date the goods are received by the Seller, unless the parties agree otherwise.
11. Final Provisions
11.1. These Terms are prepared in accordance with the laws of the Republic of Lithuania.
11.2. All relations between the Parties are governed by Lithuanian law.
11.3. Disputes arising from these Terms shall first be resolved through negotiation. If no agreement is reached, disputes are resolved in accordance with the laws of Lithuania.
11.4. The Parties are released from their obligations if they cannot be fulfilled due to circumstances beyond their control (Force Majeure).
